>> martha: good afternoon. this is martha maccallum and this is definitely "the st story" today, huge blockbuster news coming out of the courtroom in downtown manhattan connor mcdavid everybody has been waiting for. it is day 13 a former president trump's criminal trial and this has become incredibly intense in their because stormy daniels is basically spilled everything she wanted to say after the trump team had asked to have her testimony limited. 's another the trump request is in for a mistrial because they are seeing there's all this prejudicial information that the jury has heard and we can put that back in the genies bottle can recall it absolutely prejudicial saying that -- and that -- what that means is that it was designed not to serve the acclimation of the charges but simply to inflame the jury against the defendant. prosecutors have spent most of the day focus on the 2006 sexual encounter that stormy daniels claimed happened in this case, the encounter and

know, basically this is approximation, i wish there were things that had been said and it's too late. >> think about this before the jury has already heard this -- a mistrial is not -- is not incumbent upon me to claim a mistrial on this at this point. in other words let's see how much further this goes and then i'll wait in on whether or not they should be a mistrial. >> again, the problem was allowing her testimony in the first place. just bring her her understand -- again, irrelevant to the case. she has no relevance to the case, direct relevance to the crime. idea here is that you want to preserve the ends by it's nature of this proceeding in the eyes of the jury, the jury has to look at this as impartially as possible. her testimony today, and i would say specifically, you know, the title report of it, kind of ridiculing, you know, trump, her tone, but this

thing about being afraid and also implying that there was an issue with consent even, that is grounds for mistrial. the judge should be ashamed of himself. and this thing is an indictment of the new york judicial system and sadly it's humiliating for the united states of america in the eyes of the world. >> martha: and it's a great point and for what remote -- i thought i've heard all this before, you know, this has when all they are about him sitting on the bed and all this stuff. and clearly the prosecution wants to establish that this is so bad that this is obviously something wanted to cover up at any cost but i want to play for you this quick soundbite from stormy daniels in an appearance morgan interview. here's what she had to say about whether or not he should be jailed and this goes to the -- i know, can relate now. this would go to the issue of whether or not she thinks that he made her unsafe or he was threatening in any way. we have that, guys?

soundbite from earlier coverage over on an -- msnbc the is from you -- former u.s. attorney harry littman on the judge. watch... >> we are talking about a very, very colorful witness. she told a lot of jokes and not all of them landed. i haven't seen merchan in this trial be so sort of irritated and it came across, i think, as being irritated with her level of detail. my bottom line is it went fine but there were eyebrows raised in the jury. >> martha: what do you make of that? >> you look -- of all the outrageous conduct we have seen from the u.s. -- new york da's office over the course of this case whether it's clear discovery violations, games the blade with pretrial motions and with jury selection, today has to take the cake. at the start of today, judge merchan can very serious guardrails around stormy daniels' testimony and then the new york da's office just

ran absolutely roughshod over those guardrails. we think that we -- it was clear ground for a mistrial, were deeply disappointed that judge merchan did not grant our motion for a mistrial and this is an issue that we are going to continue to raise because the da's office strategy here is to pollute the entire trial with irrelevant, highly prejudicial evidence that should have no place in this trial or frankly in any courtroom. as a former prosecutor i find her conduct deeply deeply offensive and i am hopeful the judge merchan sees what's going on here. >> martha: he said that he did not see mistrial at this point but he want her essentially to stick to the things that are relevant to the trial. we know that the prosecution had discussions with w. -- from a daniels according to our reporters in the courtroom about staying focused on this because clearly they're getting a little bit nervous that merchan may be related to the point of mistrial. but he says the judge said that he is considering giving

limited instructions to the jury and that he is going to make a decision on that on thursday so that would mean that he will say to the jury look, this things that -- >> martha: imparts >> impossible to unwind about. the material introduced accorded and probably much of the material introduced by other witnesses so prejudicial and has so little probative value that it is essentially infected this case in away that i don't think a simple limiting instruction can cure. that's why we believe a mistrial is warranted. will obviously have to consider our options going forward but again i find the da's office conduct today to be particularly outrageous. i'm assuming many lawyers feel the same way based on what normal courtroom practice would be and i'm hopeful the judge merchan sees the lights in the coming days. >> martha: will scharf,

statement. we haven't gotten a straight answer from anyone in the administration or mack do you believe that the united states the demonstration under the biden administration has put a hold on the next shipment of weapons israel? >> well obviously there is a hold, they've admitted to that, but they haven't admitted to what the reasons behind that is and so we're left for speculation or mack it seems based on that that they are trying to leverage israel much and they were trying to do with public statements that the president and others were making. i think it all goes back to the same issue and that is that they want to curb israel's military operations in rafah your maga reality is even though they are talking about -- they want to see the details of how civilians are going to be protected, the truth is they don't want to see the operation rafah conducted at all. where they really are is the want to go right now to a permanent cease-fire. that is really where the administration is privately,

obviously it will take time to digest the political impact of this particular trial and it's in the middle of all the rest of it but your thoughts on these pulled at this point? >> i think the former presidents has pretty much buffeted himself in the political impact at least so far of this trial. know we don't know what happens if there is a conviction and what that means for independence and suburban woman in particular but right now he has done a pretty good job according to all the poles the receipt of characterizing this in a way that people by it. that think maybe it's not fair and it's piling on and they are not getting to the real meet of the charge, the underlying charge in all of this trial. i will say today's testimony, very salacious and the judge was as angry as we've seen him about the testimony and interrupting numerous times. so we'll see how this comes out with this particular

credible the issues before and i think it will be a lot of back-and-forth with cohen wants he gets there. think for me daniels has told these stories different ways before. she is on the stand telling this in the jury obviously is hearing this the first time. >> martha: you have an interview tonight with really fascinating political figure. we all remember when he one the senate race in pennsylvania. he had a stroke, had a lot of difficulty speaking. he is obviously improved over time and gotten better which is, you know, obviously a good story for him but you has become one of the democrat's leaving critics of president biden especially with regard to israel. what can we look forward to tonight in your interview with him? >> definitely will pull a lot of questions dealing with a. you speed -- campus protests, senator federman has from pennsylvania. is obviously in the heart of
